Terms and Conditions

Effective Date: March 20, 2026

Last Updated: March 20, 2026

Website: acaciaelderlaw.com

These Terms and Conditions (“Terms”) govern your access to and use of acaciaelderlaw.com and any related webpages, digital content, forms, communication tools, downloads, and services made available through the Site (collectively, the “Site”). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

No Legal Advice

The content on the Site is provided for general informational purposes only. It is not legal advice and should not be relied upon as a substitute for obtaining advice from a qualified attorney regarding your specific circumstances.

Your use of the Site does not create an attorney-client relationship with the Firm or any attorney affiliated with the Firm.

No Attorney-Client Relationship

Sending an email, completing a contact form, requesting a consultation, downloading materials, or otherwise communicating through the Site does not by itself create an attorney-client relationship.

An attorney-client relationship is formed only after the Firm has completed any necessary conflict review, has expressly agreed to represent you, and a written engagement agreement has been executed.

Please do not send confidential, privileged, or time-sensitive information through the Site unless and until the Firm has confirmed in writing that it represents you.

Attorney Advertising

The Site may constitute attorney advertising under applicable law and professional conduct rules. Prior results do not guarantee a similar outcome. Any description of matters, case types, results, or client experiences is not a promise or guarantee regarding the outcome of any future matter.

The Firm may only provide legal services in jurisdictions where it is authorized to do so. Nothing on the Site is intended to solicit professional employment in a jurisdiction where such content would not comply with applicable rules.

Permitted Use of the Site

You may use the Site only for lawful purposes related to learning about the Firm and its services or communicating with the Firm. You agree not to use the Site in any way that could damage, disable, overburden, interfere with, or impair the Site or the rights of others.

You agree not to attempt unauthorized access to any portion of the Site, use automated scraping tools except where expressly permitted, introduce malicious code, submit false or misleading information, or misuse contact forms, scheduling tools, or communications channels.

Intellectual Property

All content on the Site, including text, graphics, logos, icons, page layouts, downloads, images, videos, design elements, compilations, and other materials, is owned by or licensed to the Firm and is protected by intellectual property and other applicable laws unless otherwise stated.

You may view, download, and print limited portions of the Site for your personal, non-commercial use only, provided that you do not remove any proprietary notices or use the content in a misleading way. No other use, reproduction, republication, modification, distribution, or exploitation is permitted without prior written consent.

Third-Party Links and Services

The Site may contain links to third-party websites or services, including maps, scheduling tools, payment portals, video platforms, social media pages, analytics tools, or other external resources. These links are provided for convenience only.

The Firm does not control and is not responsible for third-party content, availability, privacy practices, security, or terms. Your use of third-party websites or services is at your own risk and subject to their own terms and policies.

Accuracy and No Warranties

The Firm strives to keep Site content accurate and up to date, but does not guarantee that the Site or its content is complete, accurate, current, error-free, or suitable for any particular purpose.

To the fullest extent permitted by law, the Site and all content are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and uninterrupted availability.

Reliance on Information

You are solely responsible for evaluating the information on the Site and determining whether to seek professional advice. Legal matters are fact-specific and time-sensitive. You should not delay seeking legal advice based on information on the Site.

Electronic Communications

If you contact the Firm through the Site, email, SMS, or other digital means, you consent to receive communications from the Firm through those channels, subject to applicable law and your communication preferences.

The Firm does not guarantee the confidentiality or security of information sent through the internet or other electronic channels before an attorney-client relationship has been established.

Consultations, Forms, and Scheduling Tools

The Site may allow users to request consultations, complete intake forms, schedule appointments, subscribe to communications, or submit other information. The Firm may accept, decline, or defer any inquiry or consultation request in its discretion, including where conflicts, capacity, geography, scope, ethics, or workload concerns exist.

The Firm does not guarantee availability, response time, or acceptance of any matter through the Site.

Testimonials, Reviews, and Case Descriptions

If the Site includes testimonials, endorsements, ratings, reviews, or case descriptions, they are provided for informational purposes only. They may not reflect the experience of all clients, and they do not constitute a guarantee, warranty, or prediction of outcome.

If required by applicable lawyer advertising rules, any testimonial, endorsement, or description of results should be reviewed and supplemented with any necessary disclaimer language.

Limitation of Liability

To the fullest extent permitted by law, the Firm and its attorneys, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages arising out of or related to your use of, or inability to use, the Site or any information, tools, or materials made available through the Site.

To the fullest extent permitted by law, the total liability of the Firm and its related parties for any claim arising out of or relating to the Site will not exceed the greater of (a) one hundred dollars ($100) or (b) the amount, if any, you paid directly to use the Site.

Indemnification

You agree to defend, indemnify, and hold harmless the Firm and its attorneys, employees, contractors, agents, licensors, and service providers from and against claims, demands, damages, liabilities, losses, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your violation of these Terms, misuse of the Site, or infringement of any rights of another.

Privacy

Your use of the Site is also subject to the Firm’s Privacy Policy, which is incorporated into these Terms by reference. If there is a conflict between these Terms and the Privacy Policy regarding data handling, the Privacy Policy will govern with respect to those issues.

Accessibility

The Firm seeks to make the Site reasonably accessible to users. If you encounter an accessibility barrier, please contact the Firm at nicholas@acaciaelderlaw.com with sufficient detail to help us address the issue.

Geographic Use and Jurisdictional Limits

The Site is controlled and operated from the United States and is intended for users located in the United States. The Firm does not seek to represent anyone based solely on their viewing of the Site in a jurisdiction where the Site would fail to comply with applicable law or rules.

Any discussion of legal services or legal rights is intended only in jurisdictions where the Firm and its attorneys are authorized to practice or may otherwise provide services lawfully.

Governing Law and Venue

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute arising out of or relating to the Site or these Terms shall be brought exclusively by binding arbitration, and you consent to such jurisdiction and venue.

Severability and Waiver

If any provision of these Terms is held invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect. Any failure by the Firm to enforce a provision of these Terms is not a waiver of that provision or any other provision.

Changes to These Terms

The Firm may revise these Terms at any time by posting an updated version on the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
